1 Definitions

In these Terms and Conditions, the following words and phrases shall have the meanings set out below unless the context requires otherwise:

2 Acceptance of Terms

2.1 By accessing the php38 Platform, registering an Account, or placing any Wager, you unconditionally accept and agree to be legally bound by these Terms and all documents incorporated herein by reference, including the php38 Privacy Policy and Responsible Gaming Policy.

2.2 These Terms constitute a legally binding agreement between you and the Operator. If you do not accept these Terms in full, you must immediately cease using the Platform and close any Account you have registered.

2.3 php38 reserves the right to require Players to re-confirm their acceptance of the Terms at any time, including following material amendments. Continued use of the Platform after any such amendment constitutes acceptance of the revised Terms.

2.4 These Terms are written in English. In the event of any discrepancy between an English version and any translated version of these Terms, the English version shall prevail.

3 Eligibility & Age Restriction

3.1 To be eligible to register and maintain a php38 Account, you must satisfy all of the following conditions at all times:

• You are at least 21 years of age;
• You are a natural person — corporate entities may not register player accounts;
• You are not acting as an agent, nominee, or on behalf of any third party;
• You are not a current employee, contractor, or immediate family member of a php38 employee involved in gaming operations;
• Your use of the Platform is legal in your jurisdiction of residence;
• You have not previously been self-excluded or permanently banned from the php38 Platform.

3.2 php38 reserves the right to request proof of age documentation at any time and to suspend any Account pending age verification. Accounts confirmed to belong to persons under 21 years of age will be permanently closed, and any funds in such accounts will be handled in accordance with PAGCOR responsible gaming guidelines.

3.3 Players are solely responsible for ensuring that their use of the Platform complies with applicable local laws in their jurisdiction of residence. php38 makes no representation that the services offered are lawful for use in every jurisdiction.

4 Account Registration & KYC

4.1 Each eligible Player may register only one (1) Account on the php38 Platform. Multiple accounts held by the same individual are strictly prohibited. php38 reserves the right to close all duplicate accounts and to void any transactions associated with them.

4.2 At registration, you must provide accurate, current, and complete information including your legal full name, date of birth, valid Philippine mobile number, and email address. You agree to promptly update this information if it changes.

4.3 KYC Verification. Prior to processing any withdrawal, php38 requires Players to complete identity verification by submitting a copy of at least one valid Philippine government-issued identification document. Accepted documents include, but are not limited to:

• UMID (Unified Multi-Purpose ID)
• Philippine Passport
• Driver's Licence (LTO)
• PhilHealth ID
• Voter's ID (COMELEC)
• SSS / GSIS Card
• Postal ID (Philippine Postal Corporation)

4.4 php38 reserves the right to request additional documentation including proof of address, source of funds declaration, or enhanced due diligence materials where required by PAGCOR regulations or internal risk policies.

4.5 php38 will process KYC submissions within a reasonable period. During the review period, deposits and gaming remain available, but withdrawals will be held until verification is satisfactorily completed.

4.6 Where php38 is unable to satisfactorily verify a Player's identity or eligibility, the Account may be suspended or permanently closed. In such circumstances, any undisputed balance remaining after the deduction of applicable charges will be returned to the Player via the original deposit method.

5 Account Security

5.1 You are solely responsible for maintaining the confidentiality of your php38 Account login credentials, including your password and any two-factor authentication codes associated with your Account.

5.2 php38 will never request your password by email, SMS, live chat, or any other communication channel. You must not disclose your password to any third party, including php38 support staff.

5.3 You must notify php38 immediately via the official support channels if you suspect unauthorised access to or use of your Account. php38 shall not be liable for any loss arising from unauthorised Account access that results from your failure to maintain credential confidentiality.

5.4 php38 strongly recommends enabling two-factor authentication (2FA) on your Account. Players who enable 2FA receive a one-time passcode to their registered Philippine mobile number for each login attempt, materially reducing the risk of unauthorised access.

5.5 php38 may temporarily lock an Account following multiple failed login attempts as a security measure. Players may contact support to unlock their Account after completing identity verification.

6 Deposits & Withdrawals

6.1 All transactions on the php38 Platform are conducted in Philippine Pesos (PHP / ₱). php38 does not accept deposits or process withdrawals in foreign currencies.

6.2 Accepted Payment Methods. php38 currently supports the following Philippine payment channels for deposits and withdrawals: GCash, Maya (formerly PayMaya), GrabPay, QR Ph, BPI Online Banking, BDO Online Banking, Metrobank Online, InstaPay, PesoNet, and 7-Eleven CLiQQ. The availability of specific payment methods may change without prior notice.

6.3 The minimum deposit amount is ₱100. Minimum and maximum deposit limits per transaction and per day may vary by payment method and are displayed in the Cashier section of your Account.

6.4 Deposits are credited to your Account Balance in real time for e-wallet payments (GCash, Maya) and within the processing timeframe applicable to the selected bank transfer method.

6.5 Withdrawals. Withdrawal requests are subject to successful KYC verification. Verified Players may request withdrawals at any time, subject to the minimum withdrawal amount applicable to their selected withdrawal method. php38 targets processing of e-wallet withdrawal requests within thirty (30) minutes for fully verified Accounts under standard operating conditions. Bank transfer withdrawals may take longer depending on interbank processing times.

6.6 php38 reserves the right to request additional verification documentation before processing any withdrawal that triggers internal risk thresholds or is otherwise flagged by the platform's Anti-Money Laundering (AML) controls.

6.7 php38 does not impose dormancy fees on Account Balances. However, php38 reserves the right to apply an administration charge on Accounts that have been inactive for a continuous period exceeding twelve (12) months, in accordance with the schedule published in the Account Terms section of the Platform.

6.8 Players must only use payment methods registered in their own name. php38 will not process withdrawals to a payment account held by a third party, and will reject deposits originating from accounts not belonging to the registered Player.

7 Bonuses & Promotions

7.1 php38 offers various promotions, welcome bonuses, reload bonuses, cashback offers, and other incentives to eligible Players. Each promotion is subject to specific terms published on the relevant promotion page, which terms are incorporated into this Agreement.

7.2 Wagering Requirements. Bonus Funds are subject to wagering requirements before they may be converted to withdrawable cash. The applicable wagering requirement multiplier and eligible games are specified in the relevant promotion terms. Players must satisfy these requirements within the stated validity period, failing which any remaining Bonus Funds and associated winnings will be forfeited.

7.3 php38 reserves the right to withdraw, amend, or cancel any promotion at any time without prior notice, provided that the rights of Players who have already opted into a promotion and commenced satisfying wagering requirements will not be retroactively removed without reasonable cause.

7.4 Only one welcome bonus is available per eligible Player. Players found to have created multiple Accounts to claim multiple welcome bonuses will have all associated bonuses voided and the duplicate Accounts closed.

7.5 php38 reserves the right to withhold bonus payments or void winnings where there is reasonable evidence of promotional abuse, including but not limited to coordinated wagering, arbitrage betting, or any strategy designed to exploit bonus terms rather than to engage in genuine recreational gaming.

7.6 Bonus Funds are non-transferable and have no cash value until wagering requirements are met. Bonus Funds cannot be withdrawn directly and are used solely to satisfy wagering contributions in the game categories specified in each promotion's terms.

8 Gaming Rules & Fair Play

8.1 All games available on the php38 Platform — including slot games, live casino table games, bingo, sports betting markets, and fishing games — are governed by individual game rules published within the game interface or on the applicable game information page.

8.2 Random Number Generation. All RNG-based games on the php38 Platform use certified Random Number Generators that have been independently audited and tested for fairness and unpredictability. Return-to-player (RTP) percentages are disclosed in the relevant game information. No game outcome is predetermined, manipulated, or influenced by Account status, previous results, or wager size.

8.3 Live Casino. Live dealer games are streamed from certified professional studios. All card shuffles, wheel spins, and dice rolls are visible on camera and resolved by accredited dealers in real time. php38 does not manipulate live dealer outcomes.

8.4 In the event of a technical malfunction, disconnection, or system error during an active game round, php38 will make reasonable efforts to determine the outcome and credit or refund the Player accordingly. php38's decision regarding the handling of technical malfunctions is final.

8.5 Bets placed after the closure of a wagering window, or in circumstances where the Platform has displayed an error in the odds or game parameters, may be voided at php38's discretion.

8.6 Players must not use automated software, bots, scripts, or artificial intelligence tools to access or play games on the php38 Platform. php38 employs technical measures to detect automated play, and Accounts found to use such tools will be suspended and winnings voided.

9 Prohibited Conduct

9.1 The following activities are strictly prohibited on the php38 Platform and may result in immediate Account suspension, permanent closure, and forfeiture of the Balance:

• Providing false, misleading, or incomplete information during registration or KYC;
• Registering more than one Account, whether under the same or a different identity;
• Using the php38 Platform for any form of money laundering, terrorist financing, or other financial crime;
• Depositing funds from payment accounts not registered in your own name;
• Colluding with other Players to gain an unfair advantage in any game;
• Using exploits, bugs, or glitches in any game or the Platform to generate winnings;
• Employing any form of automated software, macro, or bot during gameplay;
• Attempting to reverse-engineer, disassemble, or interfere with any element of the Platform;
• Abusing the php38 support team or engaging in threatening, discriminatory, or harassing behaviour toward php38 staff or other Players;
• Allowing, facilitating, or engaging in underage gambling on the Platform;
• Misusing the php38 affiliate or referral programme.

9.2 php38 cooperates fully with PAGCOR, the Anti-Money Laundering Council (AMLC), and relevant Philippine law enforcement agencies. php38 is required to file Suspicious Transaction Reports (STRs) and Covered Transaction Reports (CTRs) where required by the Anti-Money Laundering Act of 2001 (Republic Act No. 9160) and its implementing rules.

10 Responsible Gaming

10.1 php38 is committed to the promotion of responsible gaming and the protection of vulnerable Players. The following tools are available to all registered Players from the Account dashboard:

• Deposit Limits: Set daily, weekly, or monthly maximum deposit amounts;
• Session Time Limits: Configure maximum session duration with automatic logout;
• Loss Limits: Set maximum loss thresholds over defined periods;
• Reality Checks: Receive on-screen reminders of time elapsed and net position during active sessions;
• Cool-Off Period: Temporarily suspend your Account for a period of 24 hours to 6 weeks;
• Self-Exclusion: Voluntarily exclude your Account from all php38 services for a minimum period of 6 months or permanently.

10.2 Self-exclusion requests are processed promptly and are irrevocable for the duration of the selected exclusion period. If you choose permanent self-exclusion, the Account cannot be reopened under any circumstances.

10.3 During any self-exclusion or cool-off period, php38 will take reasonable steps to ensure that marketing communications are suspended and that re-entry to the Platform is prevented.

10.4 php38 is strictly a 21-and-above platform. If you are aware of any underage person attempting to access the php38 Platform, please report this immediately to our support team.

11 Intellectual Property

11.1 All content on the php38 Platform — including but not limited to the php38 name and logo, software, game interfaces, graphics, text, audio-visual elements, database compilations, and the overall Platform design — is the intellectual property of the Operator or its licensed content providers and is protected under applicable Philippine and international intellectual property laws.

11.2 You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for personal recreational gaming purposes, subject to these Terms. This licence does not include any right to copy, reproduce, distribute, commercially exploit, or create derivative works from any Platform content.

11.3 The php38 name, logo, and all associated trademarks are the property of the Operator. Unauthorised use of php38 trademarks, including in domain names, social media accounts, or promotional materials not authorised in writing by php38, is strictly prohibited.

12 Limitation of Liability

12.1 To the maximum extent permitted by applicable Philippine law, php38 shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of or inability to use the Platform.

12.2 php38's total aggregate liability to any Player in respect of any claim arising from or in connection with these Terms or the use of the Platform shall not exceed the aggregate sum deposited by that Player in the ninety (90) day period immediately preceding the event giving rise to the claim.

12.3 php38 does not guarantee uninterrupted access to the Platform. The Platform may be temporarily unavailable due to scheduled maintenance, unscheduled technical issues, telecommunications failures, or force majeure events. php38 shall not be liable for any loss arising from Platform unavailability.

12.4 php38 does not warrant that the Platform will be free from software errors, viruses, or other harmful components. You are responsible for ensuring that your device and connection are adequately secured before accessing the Platform.

12.5 Nothing in these Terms shall limit or exclude php38's liability for fraud, wilful misconduct, or any liability that cannot be lawfully excluded under Philippine law.

13 Suspension & Termination

13.1 php38 reserves the right to suspend or permanently close any Player Account, at any time and without prior notice, in the following circumstances:

• Breach of any provision of these Terms;
• Suspicion of fraudulent, abusive, or unlawful activity;
• Failure to complete KYC verification within the required period;
• Player is found to be under 21 years of age;
• Account is subject to a legal hold, court order, or regulatory direction;
• Reasonable suspicion of money laundering, terrorist financing, or breach of AMLC obligations;
• Player is in self-exclusion or has been added to a PAGCOR exclusion register.

13.2 Upon Account closure for breach of Terms, php38 reserves the right to void all pending and unsettled bets, forfeit Bonus Funds, and withhold withdrawal of funds pending investigation.

13.3 Where an Account is closed at php38's discretion for reasons other than Player misconduct, any verified Balance will be returned to the Player via the original deposit method after deduction of any amounts lawfully owed by the Player to php38.

13.4 A Player may request closure of their own Account at any time by contacting php38 support. Accounts closed at Player request are subject to the same withdrawal and KYC processes applicable to standard withdrawals.

14 Governing Law & Dispute Resolution

14.1 These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

14.2 In the event of a dispute between php38 and a Player, both parties agree to first attempt resolution through php38's internal complaints process. Players may submit a formal complaint via the official php38 support channels. php38 will acknowledge complaints within two (2) business days and provide a substantive response within fifteen (15) business days.

14.3 If a complaint cannot be resolved through the internal process, the Player may escalate the matter to PAGCOR's player dispute resolution mechanism in accordance with PAGCOR's published procedures.

14.4 Each party irrevocably submits to the exclusive jurisdiction of the competent courts of the Republic of the Philippines for any dispute not resolved through the above processes.

15 Amendments to These Terms

15.1 php38 reserves the right to amend, update, or replace these Terms at any time. Any material changes will be communicated to registered Players via email to the address registered on the Account and/or by a prominent notice displayed on the Platform.

15.2 The effective date of any amended Terms will be clearly stated at the top of this page. It is your responsibility to review these Terms periodically. Your continued use of the Platform after the effective date of any amendment constitutes your unconditional acceptance of the revised Terms.

15.3 If you do not agree to any amended Terms, you must cease using the Platform and may request Account closure in accordance with Section 13.4 above.

16.2 All formal complaints must be submitted in writing (email or live chat transcript) and include the Account username, the nature of the complaint, the relevant transaction or game reference if applicable, and the resolution sought.
